Prosecutors allege that Fanyue Gong, 43, a Chinese national living in New York, and Benlin Yuan, 58, a Canadian citizen originally from China, conspired with a Hong Kong-based logistics firm and a China-based AI technology company to bypass U.S. export restrictions. The core tactic involved disguising the true destination of the chips and using fake or misleading customer details to move the goods overseas.
Court filings describe how Nvidia chips were acquired via straw purchasers and intermediary actors. The goods were mislabeled as destined for U.S. customers or for third countries such as Taiwan or Thailand. Once in the chain, shipments were routed to multiple U.S. warehouses where labels were removed and replaced with ones tied to a purported company. From there, the chips were prepared for export.
A separate complaint details Yuan’s role in recruiting and organizing individuals to inspect the mislabeled chips for the Hong Kong logistics company. Prosecutors say he directed inspectors not to reveal that the goods were headed to China and coordinated discussions about crafting a narrative to facilitate the release of the chips and other equipment after federal authorities detained them.
The timeline, according to court records, stretches back to at least November 2023. Another participant, Alan Hao Hsu, 43, and his firm pleaded guilty in October to related smuggling and unlawful export offenses tied to the scheme. Authorities say Hsu and his company received over $50 million in wire transfers from China to support operations that exported or attempted to export at least $160 million worth of Nvidia GPUs controlled for export.
Officials framing the case describe it as a sophisticated network capable of exposing sensitive AI technology to actors who could threaten American interests. The U.S. attorney for the Southern District of Texas underscored the broader risk: while legitimate buyers use GPUs in everyday settings, illicit flows of second-hand or mislabeled equipment undermine security efforts.
Nvidia, for its part, cautions that legitimate, older-generation GPUs sold on secondary markets are subject to strict security reviews. Inquiries to the Chinese Embassy in Washington or Yuan’s counsel did not yield responses.
Context matters: since 2022, the U.S. has tightened export controls to curb China’s access to advanced semiconductors and related equipment. A 2025 expansion added subsidiaries owned by restricted entities to the prohibition list automatically, broadening the government’s reach.
